Waiver Acknowledgement
Waiver of Liability and Hold Harmless Agreement
1. In consideration for being allowed to participate in activities related to baseball and softball training, including but not limited to personal instruction, cage rental, clinics, and exercise services, I RELEASE, WAIVE, DISCHARGE and PROMISE NOT TO SUE Metropolitan Sports Camp, Inc, Old Tappan Boot. Camp Inc., its affiliates, personal instructors/trainers (employees or contractors), and/or the owners of the premises in which the activities take place, including their heirs and assigns (hereinafter referred to as Releasee), from any and all liability, claims, demands, actions and causes of action (whether known or unknown) arising in any way out of or related to any loss, damage, or injury, including permanent disability or death, that may be sustained by me or my property, caused by the negligence of the Releasee or otherwise, while participating in such activity, or while in, on, or upon the premises where the activity is being conducted, to the fullest extent provided by law.
2. I am familiar with and fully aware of the risks and hazards connected with activities related to baseball and softball training and other physical activity, including but not limited to personal instruction, cage rental, clinics, and exercise, and I elect to voluntarily participate in the activity, and to engage in such baseball and softball training knowing that the activity may be hazardous to me and/or my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY for any risks of loss, property damage or personal injury, including permanent disability or death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in the activity whether caused by the negligence of Releasee or otherwise.
3. I further agree to indemnify and hold harmless the Releasee from any loss, liability, damage or costs, including court costs and attorney fees that they may incur due to my participation in activities related to baseball and softball training, including but not limited to personal instruction, cage rental, clinics, and exercise services, whether caused by the negligence of Releasee or otherwise.
4. It is my express intent that this Release and Hold Harmless Agreement shall bind the members of my family and spouse if I am alive, and my heirs, assigns, and personal representative if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, and COVENANT NOT TO SUE the above named Releasee. I further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of New Jersey.
In signing this release, I acknowledge and represent that I have read the above Waiver of Liability and Hold Harmless Agreement, fully understand it, and sign it voluntarily as my own free act and deed. No oral representations, statements, or inducements apart from the foregoing written agreement have been made. I am at least eighteen (18) years of age and fully competent, and I execute this Release in exchange for being allowed to participate in Baseball and Softball Training fully intending to be bound by same. Parent or Guardians signing for minors assume all liability and risk and agree to the above conditions.
5. Covid-19 Waiver Release. I RELEASE, WAIVE, DISCHARGE and PROMISE NOT TO SUE Metropolitan Sports Camp, Inc, Old Tappan Boot. Camp Inc., its affiliates, personal instructors/trainers (employees or contractors), and/or the owners of the premises in which the activities take place, including their heirs and assigns (hereinafter referred to as Releasee), from any and all liability, claims, demands, actions and causes of action (whether known or unknown) arising in any way out of or related to any loss, damage, or injury, including permanent disability or death, that may be sustained by me or my property, caused by the negligence of the Releasee or otherwise, related to Covid-19. We cannot guarantee you will not get Covid-19 from entering our facility. If you have symptoms or if you have Covid-19, you agree to alert us and agree to not attend until cleared by a doctor. All CDC guidelines must be followed while in the facility and on the grounds. Face masks must be worn at all times and social distancing must be practiced.
